Here's your guide to registering products in New York.
Which product types to register
In New York, you'll need to register:
- Beer
- Low ABV wine (done as a No COLA registration)
- Cider
- Spirits
- Non-malt beverages (like seltzer, kombucha, etc.)
You'll need to include the following information for each product you register:
- Alcohol by Volume (ABV)
- Size
How to register your products
You must register all alcoholic beverages for all product types sold in the state of New York as a new brand label. A brand label is made up of the following 4 components:
- Brand or trade name
- Class and type of the alcoholic beverage
- Net contents of the container
- Any other labeling information required by the TTB (for example, alcohol content, flavor description, etc.)
The following exceptions don't constitute a new brand label:
- Cordial and liqueur brand label names, if the only difference is the flavor description
- Wine brand label names, if the only difference is vintage year
- Gin brand label names, if the only difference is the addition of the designation dry
- Rum brand label names, if the only difference is the addition of the designation white, light, dark, gold or silver
- Changes to ABV don't need to be registered as a revision for beer, wine, or cider products
- Size additions (additional container sizes) don't need to be registered
State fees and approval time
New York registrations are valid for 3 years. Fees are prorated by the year you register your product. Renewals are effective for the full 3-year period, and therefore cost the maximum amount.
Beer | Wine | Cider | Spirit | |
New Brand Label | $150-450 | $50-150 | $150-450 | $250-750 |
Renewal | $450 | $150 | $450 | $750 |
In addition to the state fee, you'll also pay a $10 technology charge.
Fees paid via ACH take around 5 business days to clear. After this, the state will be able to view your registration, and approve or deny the application.
Small batch exemption
Liquor, beer, and cider produced in small batches are exempt from the brand label registration fee. Small batches mean:
- For liquor, 1000 gallons or less per year
- For beer and cider, 1500 barrels or less per year
The fee exemption applies to products under the same state brand label registration. The total annual amount of product manufactured includes not only the amount of product manufactured for sale in New York, but the entire annual amount of the product that is manufactured, regardless of where it will be sold. If the total annual amount of product that you've manufactured exceeds (or is anticipated to exceed) the amount listed here, you'll need to pay the state fee.
If your annual production volume exceeds the Small Batch amounts, you'll indicate it under Product Details. Check the box next to Exceeds Annual Brand Label Production Volume. Checking this box will mean your registration is subject to the state fee.
